Consular Services offered by the High Commission of India, Nairobi (KENYA)

Passport & Consular services offered at the High Commission of India include issue of fresh passports to Indian nationals, re-issue of passports, issue of new passports/travel documents in lieu of lost/damaged passports, issue of PIO (Persons of Indian Origin) cards, issue of OCI (Overseas Citizenship of India) cards, miscellaneous passport services (change of address, ECNR endorsement, issue of Police Clearance Certificate, registration of deaths of Indian citizens, attestation of documents such as affidavits, power of attorney, sponsorship declarations, etc.)

1. Registration of Indian Nationals
Indian citizens residing in Kenya, Eritrea and Somalia are advised to register themselves with the High Commission of India, Nairobi, if they are not already registered. They are also advised to keep the High Commission informed whenever there is any change in their address, profession, telephone number, e-mail address, etc. or when they acquire foreign nationality or leave the country for good.

2. Yellow Fever Vaccination Certificate
All persons visiting India from Kenya, Eritrea or Somalia are required to be in possession of a valid Yellow Fever Vaccination Certificate. The validity of the Certificate starts 10 days after the date of inoculation. Children below 1 year of age are exempt from this requirement.
Instructions on passport and consular services
Please read the following instructions carefully:
General Instructions
(i) Your passport is a valuable document. It should always be either in your own custody or in the custody of a person duly authorised by you. It must not be altered or mutilated in any way. If lost or stolen, the fact and circumstances should immediately be reported to the local police station and police report obtained and should also be reported at the nearest Indian Mission. 

(ii) It is an offence under the Passports Act, 1967 to furnish false information in the application. Passport facilities can be denied on grounds of suppression of factual information, submission of false particulars, wilful damage of passport and for making unauthorised changes in the passport.

(iii) Your passport can be impounded or revoked by the Government of India under the provisions of the Passports Act, 1967, in which event you will have to surrender the passport to the nearest Indian Mission.

(iv) A passport should not be sent out of any country by post.
(v) Please keep a photocopy of the passport in a safe place. Without a copy, issuance of a new passport in case of loss/damage/theft may be delayed.

(vi) Mode of Payment of Fees:
To be deposited by the applicant only at the Bank of India, Kenyatta Avenue Branch, in cash against the voucher issued to the applicant after acceptance of the application at the High Commission’s Counter.
It may also be noted that fees once received will not be refunded under any circumstances, even if the applicant withdraws the application or service is not rendered by the High Commission for any reason.
(vii) No telephonic/fax/e-mail queries regarding status of visas, passports or miscellaneous services etc. will be entertained before the time limit indicated for processing the different services. Processing time of applications is reckoned from the date of acceptance of the applications and payment of the requisite fee.
EMERGENCIES: Holidays, business trips, confirmed bookings made before obtaining visa do not qualify as emergencies and will not be treated as such. Emergencies by definition refer to unexpected urgent situation. Emergency applications must be supported by documentary evidence.
Jurisdiction
The High Commission of India has its consular jurisdiction over Kenya (except the Coast Province), State of Eritrea and Republic of Somalia.

Timings
Applications for all passport/consular services are received at the counter only between 0900 hours and 1200 hours on all working days.
Processed documents will be delivered only between 1400 hours and 1600 hours on all working days upon production of the original payment receipt.

3. Re-Issue of Passports
General Information: Keeping in view the guidelines of the International Civil Aviation Organisation (ICAO), that citizens travelling internationally will be mandatorily required to carry Machine Readable Passports from the year 2014, Government of India has centralised its passport issuing system since August 2007. Applications for new passports made at any Indian Mission/Post are duly processed and Machine Readable Passport Booklets (MRP Booklets) are printed in Delhi. The passports are then despatched by courier to the respective Indian Mission/Post for delivery to the applicant.
(i) A new passport can be applied for immediately on its expiry, or on exhaustion of pages in the passport, or due to change of name after marriage, or due to change of appearance, or up to one year before its expiry. The application for a new passport should be submitted along with the existing passport in original, photocopy of the data pages and the page(s) containing residence permit/entry permit/re-entry pass endorsements, four recent passport-size photographs and the requisite fee. (ii) In case more than one year has elapsed since the expiry of the passport, the applicant will also need to submit an affidavit stating that he/she has not acquired Kenyan nationality along with a letter from the Kenyan Department of Immigration, confirming the same.

(iii) The particulars of most passports issued from Passport Offices in India and from some Indian Missions/Posts can now be verified by the High Commission online. In all other cases, when the passport particulars cannot be verified readily, a confirmation from the issuing office has to be awaited before the application for a new passport is processed. However, if the confirmation is not received within 30 days, the new passport will be processed at the discretion of the High Commission. Telex Fee is charged initially in such cases.

(iv) Children up to the age of 15 years are issued with a passport of five years validity only. The minor’s passport application should be accompanied by the passports of both parents.
Fee:                (i) KSh. 3,200/- for a 36-page booklet;                                                                                                (ii) KSh. 3,900/- for a 64-page booklet (Jumbo);                                                                                       (iii) KSh. 2,000/- for minor children up to 15 years of age;                                                                (iv) Telex Fee – KSh. 200/-.
Processing Time:         4 weeks.

4. Issue of New Passports due to Change in appearance
If your appearance has changed significantly since your last passport was issued to you, you can apply for a fresh passport. The application in the form meant for issue of a new passport should be submitted along with the existing passport in original, photocopy of the data pages and the page(s) containing residence permit/entry permit/re-entry pass endorsements, four recent passport-size photographs and the requisite fee. 5. Issue of New Passports due Change of Name after marriage
If your surname has changed consequent to marriage and you want a new passport in your married name, you will need to fill out the application form meant for a new passport along with four recent passport-size photographs. You also need to enclose your current passport, your original marriage certificate with a photocopy, your spouse’s passport and the requisite fee. 6. Registration of Births & Issue of Fresh Passport to Newly Born Children
A child born outside India before 12.12.1992 is eligible for Indian citizenship by descent only if the father held Indian nationality at the time of the child’s birth. After this date, a child born outside India is eligible for Indian citizenship if either of the parents is an Indian citizen. Birth of a child is required to be registered with the High Commission within one year of occurrence. Application for a fresh passport along with the duly filled in Birth Registration Form in duplicate should be submitted enclosing therewith the child’s birth certificate issued by the competent local authority in original with photocopy, original passports of both parents with photocopies of the data pages, their marriage certificate in original with photocopy, four passport-size photographs of the child and the requisite fee. 7. Issue of New Passports In Lieu of Lost/Damaged Passports
The application for a new passport in lieu of lost/damaged passport should be submitted along with four recent passport-size photographs, police report (in case of lost passport), photocopy of lost passport (original and photocopy in case of damaged passport) or any other document in support of the applicant’s Indian nationality and proof of residence in Kenya, viz., residence permit/entry permit/dependant’s pass and the requisite fee. 8. Issue of Short Validity Passports in Emergency
If you are in urgent need of a new passport, a short validity hand-written passport (valid for one year) can be issued within 3 days of submitting the application. The short validity passport is issued only in emergency against payment of a Tatkaal Fee in addition to the normal fees. The validity of such a passport is non-extendable and applicants must apply afresh for a normal passport before the date of expiry. The application in the form meant for issue of a new passport should be submitted along with the existing passport in original, photocopy of the data pages and the page(s) containing residence permit/entry permit/re-entry pass endorsements, four recent passport-size photographs, a letter explaining the emergency circumstances under which the application is being made and the requisite fee. 9. Issue of Emergency Certificates
Emergency Certificate is issued in case of loss of passport, typically for short-stay visitors and stranded passengers who wish to return to India urgently. Emergency Certificate is also issued to those who do not have any residence status in Kenya. Emergency Certificate is a short-duration (normally 10 days) one-way travel document. Applicants must be able to prove that they are Indian citizens. Applicant has to personally appear before the Consular Officer and explain the circumstances necessitating the issue of an Emergency Certificate. The certificate will be granted only after the Consular officer is satisfied with the bonafides of the applicant with regard to his/her Indian nationality, and if necessary, after verification with the authorities in India.
The completed application form (application form can be downloaded here) should be submitted at least 3 days prior to the date of journey to India with photocopy of the passport or any other document substantiating the applicant’s claim to Indian citizenship, original police abstract registering the loss of passport, journey details issued by the airline carrier or travel agent, four recent passport-size photographs and the requisite fee.
Fee:                KSh. 400/-.
Processing Time:         Depending on the urgency of the case.

10. Miscellaneous Consular Services
Miscellaneous services include change of address in passport, endorsement of spouse name (in case of male applicants), ECNR endorsement, issue of Police Clearance Certificate, registration of deaths of Indian citizens, attestation of documents such as affidavits, power of attorney, sponsorship declarations, renunciation of Indian citizenship, etc.

11. Endorsement of Change of address in passport
The Miscellaneous Services Application Form, duly filled in, should be submitted along with the existing passport in original, photocopy of the data pages and the page(s) containing residence permit/entry permit/re-entry pass endorsements, two recent passport-size photographs, original and photocopy of the document showing the new address of the applicant (this can be in the form of a utility bill like electricity/water/telephone bill or bank statement/passbook) and the requisite fee. 12. Endorsement of Spouse Name in passport (in case of male applicants)
The Miscellaneous Services Application Form, duly filled in, should be submitted along with the existing passport in original, photocopy of the data pages and the page(s) containing residence permit/entry permit/re-entry pass endorsements, two recent passport-size photographs, original and photocopy of the Marriage Certificate, original and photocopy of the spouse’s passport and the requisite fee. 13. Endorsement of Emigration Check Not Required (ECNR) in passport
The Miscellaneous Services Application Form and the ECNR Form, duly filled in, should be submitted along with the existing passport in original, photocopy of the data pages and the page(s) containing residence permit/entry permit/re-entry pass endorsements, two recent passport-size photographs and the requisite fee. 14. Issue of Police Clearance Certificate (PCC)
The Miscellaneous Services Application Form and the PCC Form, duly filled in, should be submitted along with the existing passport in original, photocopy of the data pages and the page(s) containing residence permit/entry permit/re-entry pass endorsements, two recent passport-size photographs and the requisite fee. Processing Time:         2 to 35 days (depending on verification of passport).

15. Registration of Deaths of Indian Citizens
The Miscellaneous Services Application Form, duly filled in, should be submitted by the informant along with the existing passport of the deceased person in original, photocopy of the data pages, original and photocopy of the Death Certificate issued by the local authorities, permit for burial, or permit for embalming if the dead body has to be transported to India for the last rites, photocopy of the date pages of the passport of the informant and two recent passport-size photographs of the informant. 16. Attestation of Documents
The Miscellaneous Services Application Form, duly filled in, should be submitted along with the existing passport in original, photocopy of the data pages, original and photocopy of the document to be attested and two recent passport-size photographs. Please note that for attestation of school leaving certificate/migration certificate/marks sheet etc., these documents must first be certified by the Ministry of Education, Government of Kenya. Attestation of Pension papers (Life Certificate)
The Life Certificate proforma issued by the Pension Disbursing Office should be submitted along with the existing passport in original. Please note that the pensioner has to appear personally before the Consular Officer and sign the Life Certificate proforma.

Processing Time:         Same day.

Attestation of Affidavit (Consent letter from the parent for applying for a passport for a minor child in India)
The Miscellaneous Services Application Form and the Affidavit Form - in duplicate, duly filled in, should be submitted along with the existing passport in original, photocopy of the data pages and the page(s) containing residence permit/entry permit/re-entry pass endorsements and two recent passport-size photographs. Attestation of General Power of Attorney for sale, purchase, transfer or mortgage of real estate or movable property in India
The Miscellaneous Services Application Form, duly filled in, should be submitted along with the existing passport in original, photocopy of the data pages and the page(s) containing residence permit/entry permit/re-entry pass endorsements, original and photocopy of the Power of Attorney document duly certified by a Notary Public of the Government of Kenya and two recent passport-size photographs. Fee:                 Ksh. 1,600/- for each copy of Power of Attorney document to be attested & to be paid at the High Commission’s counter.

Attestation of Sponsorship Declaration
The Miscellaneous Services Application Form and the Sponsorship Form - in duplicate, duly filled in, should be submitted along with the sponsor’s existing passport in original, photocopy of the data pages and the page(s) containing residence permit/entry permit/re-entry pass endorsements, latest statement of bank account of the sponsor or a letter from his/her employer indicating monthly income, photocopy(ies) of the passports of the visitor(s) from India, and two recent passport-size photographs. 18. Renunciation of Indian Citizenship
The Indian Citizenship Act does not allow dual citizenship. Therefore, Indian passport holders are required to surrender their passports to the nearest Indian Mission/Post immediately after acquisition of nationality of another country, irrespective of their age and obtain Renunciation Letter. The Miscellaneous Services Application Form and the Form of Declaration of Renunciation of Indian Citizenship – in duplicate, duly filled in, should be submitted along with the existing Indian passport in original, photocopy of the data pages, original and photocopy of the Citizenship Certificate of the foreign country, photocopy of passport of Indian guarantor and four recent passport size-photographs. 19. Penalty for retention of Indian passport and/or travelling on it even after obtaining foreign citizenship
It has been observed that many individuals continue to retain their Indian passports and some even travel on them and there are yet others who get fresh passports issued by suppression of information even several years after they have acquired foreign citizenship.
It is an offence under Section 12 (1A) of the Indian Passports Act, 1967 to continue to hold an Indian passport, travel on it or apply for renewal of the same by suppressing the fact of their having acquired foreign citizenship. Such individuals shall be penalised with a fine ranging from Indian Rupees 10,000/- to 75,000/-. This penalty shall be levied at the time of surrendering the Indian passport for obtaining the Renunciation Letter. However, a grace period of three months is allowed from the date of acquisition of foreign citizenship for travelling on Indian passport before surrendering it.
